If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Service Description

GenGrowth provides an AI-powered organic growth engine that helps digital products discover growth opportunities, generate strategies, execute campaigns, and measure results. The Services include data analysis, content generation, social media management, and performance tracking.

3. Account Registration

• You must provide accurate, complete registration information and keep it updated.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must notify us immediately of any unauthorized use of your account.
• One person or legal entity may maintain no more than one free account.

4. Acceptable Use

You agree not to:

• Use the Services to violate any applicable law or regulation
• Generate or distribute spam, misleading content, or malware
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse engineer, decompile, or disassemble any part of the Services
• Use the Services to engage in any form of market manipulation or fraud
• Exceed API rate limits or circumvent usage restrictions
• Scrape, crawl, or use automated means to access the Services except through our provided APIs

5. AI-Generated Content

Our Services use artificial intelligence to generate growth strategies, content drafts, and recommendations. You acknowledge that:

• AI-generated outputs may require human review before publication
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content
• You are responsible for reviewing and approving all content before it is published on third-party platforms
• GenGrowth is not liable for any consequences arising from the use of AI-generated content

6. Intellectual Property

GenGrowth and its licensors own all rights to the Services, including software, algorithms, designs, and documentation. You retain ownership of your data and content submitted to the platform. By using the Services, you grant us a limited license to process your data solely to provide the Services.

7. Third-Party Services

The Services integrate with third-party platforms (Google, Reddit, X, etc.). Your use of these integrations is subject to the respective third-party terms. We are not responsible for third-party service availability, policies, or content.

8. Payment and Billing

• Paid plans are billed in advance on a monthly or annual basis.
• All fees are non-refundable except as required by law or as specified in our refund policy.
• We reserve the right to change pricing with 30 days' prior notice.
• Failure to pay may result in suspension or termination of your account.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GROWTH RESULTS ARE GUARANTEED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GENGROWTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER DIRECT OR INDIRECT. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless GenGrowth and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

12. Termination

Either party may terminate at any time. We may suspend or terminate your access immediately if you violate these Terms. Upon termination, your right to use the Services ceases. We will make your data available for export for 30 days after termination.

13. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

14. Changes to Terms

We may modify these Terms at any time. Material changes will be notified via email or prominent notice on our website at least 30 days before taking effect. Continued use after changes constitutes acceptance.
